Alex dos Santos assists in appeal in respect of cash transited to Italy in Pringles tubes and chocolate boxes

Alexander dos Santos, led by Kennedy Talbott QC and instructed by Zaiwalla & Co Solicitors, successfully appealed against a cash forfeiture order imposed last year at Uxbridge Magistrates’ Court. The appeal lasted three days at Isleworth Crown Court.

The National Crime Agency had applied for forfeiture by reason of the manner in which cash was being carried from the UK to Italy – Pringles tubes and chocolate boxes – and focussed heavily on deficiencies in accounting practice, for which experts were called on both sides.

At the conclusion of the evidence and submissions, the Court ruled that irrespective of haphazard business record keeping in the matter, the National Crime Agency had failed to show to the civil standard that the cash in question was recoverable property or intended for unlawful conduct.
