Louise was instructed to represent a Manager at Surrey and Borders NHS Trust who was accused of abusing her position by approving invoices up to her personal approval limit of £5000 where cumulatively the invoices totalled in excess of this and should (under the Trust’s Standing Financial Instructions (“SFI’s”) have been put out to competitive tender.
The total extent of the alleged Fraud was in excess of £300,000 over four years. The case was curious in that the Crown accepted that there had been no financial benefit to her.
By careful preparation and analysis of the evidence Louise was able to demonstrate that there was a culture of non-compliance with the SFIs within the Trust and that the Defendant had been singled out (perhaps unfairly) for prosecution. The verdict concludes a four year nightmare for the client.
